16102881DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 11-4.6 as follows:
§ 11-4.6. Certain provisions in contracts for sale or lease of consumer goods or services declared void.
A. No contract for the sale or lease of consumer goods or services shall contain a provision requiring a consumer to waive his right to make any statement regarding his experience with the seller or lessor or its employees or agents or concerning the consumer goods or services. Any such provision so contained is void and unenforceable.
B. Any waiver of the provisions of this section shall be deemed to be against public policy and void.
C. This section shall not apply to any consumer statement regarding the consumer's experience with the seller or lessor or its employees or agents or concerning the consumer goods or services made with the knowledge that it is false or with reckless disregard for whether it is false.
D. This section shall not prohibit or limit a person or business that hosts online consumer reviews or comments from removing a statement that is lawful to remove.
