16103012DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Article 1 of Chapter 7 of Title 17.1 a section numbered 17.1-705.2 as follows:
§ 17.1-705.2. Days when circuit courts shall be open.
Subject to § 2.2-3300 and § 17.1-207, the Judicial Council may determine when the circuit courts of the Commonwealth shall be open for business. Any closing of the circuit courts pursuant to this section shall have the same effect as provided in subsection B of § 1-210.
[ Notwithstanding any other provision of law, general or special, in the event the closing schedule of a circuit court differs from that of a local governing body, for any employee of the circuit court clerk whose salary is paid either in whole or in part by the local governing body, the locality shall not require such employee to take a day of annual leave or reduce such employee's annual compensation.
2. That the provisions of this act shall not be construed to empower the Judicial Council to set the hours of operation of a circuit court clerk. ]
