H.B. 171 Alcoholic beverage control; food-beverage ratio for certain mixed beverage licensees.

Alcoholic beverage control; food-beverage ratio for certain mixed beverage licensees. Provides that for persons holding a mixed beverage restaurant, caterer's, or limited caterer's license, in calculating the minimum 45 percent ratio of food to mixed beverage and food, such licensees shall include the gross receipts from the sale of nonalcoholic beverages served on the premises in calculating the gross receipts from the sale of food. The bill provides that it declarative of existing law.

H.B. 481 Compliance with detainers; U.S. Immigration and Customs Enforcement.

Compliance with detainers; U.S. Immigration and Customs Enforcement; Criminal Injuries Compensation Fund. Requires that the Director of the Department of Corrections or other official in charge of the facility in which an alien is incarcerated who receives any detainer from U.S. Immigration and Customs Enforcement shall not release such alien except to transfer custody of the alien to another facility or to U.S. Immigration and Customs Enforcement, provided that no alien may be held in custody in excess of the date that he would otherwise be released from custody. The bill also provides that any person who is injured by an alien released from custody after receiving such detainer is eligible for compensation to be paid from the Criminal Injuries Compensation Fund.

H.B. 675 Auxiliary grants; supportive housing providers.

Auxiliary grants; supportive housing. Extends eligibility for auxiliary grants to include individuals residing in supportive housing, provided that the supportive housing provider has entered into an agreement for the provision of supportive housing with the Department of Behavioral Health and Developmental Services. The bill establishes requirements for providers of supportive housing that enter into agreements with the Department.

 A BILL to amend and reenact § 51.5-160 of the Code of Virginia and to amend the Code of Virginia by adding a section numbered 37.2-421.1, relating to auxiliary grants; supportive housing.

H.B. 676 Financial exploitation of adults; DARS work group to study.

DARS; work group to study financial exploitation of adults in the Commonwealth. Directs the Commissioner of the Department for Aging and Rehabilitative Services, together with the Director of the Department for Planning and Budget or his designee, representatives of the Department of Social Services' Adult Protective Services Unit and local department of social services' adult protective services units, law enforcement agencies, financial institutions in the Commonwealth, and organizations representing elderly individuals and adults with disabilities, to determine the cost of financial exploitation of adults in the Commonwealth and develop recommendations for improving the ability of financial institutions to identify financial exploitation of adults, the process by which financial institutions report suspected financial exploitation of adults, and interactions between financial institutions and local adult protective services units investigating reports of suspected financial exploitation of adults and to report on his activities and recommendations to the Governor and the General Assembly by January 1, 2017.

A BILL to require the Commissioner of the Department for Aging and Rehabilitative Services to convene a work group to study financial exploitation of adults in the Commonwealth.

Repeals the authority of a local board of social services to proceed in a manner provided by law against any person who is liable for support of an applicant or recipient of public assistance to require such person, if of sufficient financial ability, to support the applicant or recipient.

H.B. 835 Alcoholic beverage control; privileges of licensed art instruction studios.

Alcoholic beverage control; privileges of licensed art instruction studios. Expands the privileges of an art instruction studio licensee to allow the consumption of lawfully acquired alcoholic beverages on its premises by any bona fide customer and provides that the licensee may allow any bona fide customer to host a private gathering or special event where such customer has obtained a banquet license or a mixed beverage special events license issued by the Alcoholic Beverage Control Board.

H.B. 879 Alcoholic beverage control; farm wineries and limited brewery licenses, "land zoned agricultural."

Alcoholic beverage control; farm wineries and limited brewery licenses; land zoned agricultural. Clarifies that for farm wineries or limited breweries "land zoned agricultural" means land zoned as (i) an agricultural district or classification or (ii) a classification that permits agricultural use. "Land zoned agricultural" does not include land zoned "residential conservation." The bill provides that it does not apply to any farm winery or limited brewery holding a valid license granted by the Alcoholic Beverage Control Board before July 1, 2016.

H.B. 904 Alcoholic beverage control; limited mixed beverage license for retail cigar shops.

Alcoholic beverage control; limited mixed beverage license for retail cigar shops. Creates a new limited mixed beverage license for retail cigar shops. The bill sets out the privileges of this new license, including that the licensee may serve wine, beer, or mixed beverages on the premises to any such bona fide customer; however, the licensee shall not give more than (i) two five-ounce glasses of wine, (ii) two 12-ounce glasses of beer, or (iii) two glasses mixed beverages provided that each glass of mixed beverages contains no more than two ounces of spirits, to any such customer, nor shall it sell or otherwise charge a fee to such customer for the wine, beer, or mixed beverages served or consumed. The privileges of this license shall be limited to the premises of the cigar shop regularly occupied and utilized as such. Such license shall be deemed a retail license for the purposes of this title.. The bill also  defines cigar shop and sets out the state and local license taxes for this license.

Adds conviction or a finding that a person is not guilty by reason of insanity of any offense that results in the offender's requirement to register with the Sex Offender and Crimes Against Minors Registry to the list of crimes that constitute a barrier to licensure as a child welfare agency or assisted living facility, approval as a foster or adoptive parent by a child-placing agency, approval as a family day home by a family day system, or employment or serving as a volunteer at a children's residential facility, assisted living facility, adult day care center, or child welfare agency.

H.B. 1189 Child welfare agency; operating without a license, abuse and neglect of child, penalty.

Operation of a child welfare agency without a license; negligence resulting in death of or injury to a child; penalty. Provides that operating or engaging in the conduct of a child welfare agency without first obtaining a license when it is known that such license is required or after such license has been revoked or has expired constitutes a willful act or omission for purpose of the crime of abuse and neglect of a child. Under current law, a parent, guardian, or other person responsible for the care of a child who by willful act or omission causes or permits serious injury to the life or health of such child is guilty of abuse and neglect of a child, which is punishable as a Class 4 felony.

Requires the Director of the Department of Corrections to develop and administer a survey of each correctional officer who resigns, is terminated, or is transitioned to a position other than correctional officer for the purpose of evaluating employment conditions and factors that contribute to or impede the retention of correctional officers.

H.B. 1350 Alcoholic beverage control; spirits tastings by distiller licensee.

Alcoholic beverage control; distiller's license; tastings. Provides that an agent of the Beverage Control Board appointed by the Board may give samples of spirits ( in addition to beer, wine, or cider) to persons to whom alcoholic beverages may be lawfully sold for on-premises consumption, provided that (i) the spirits samples are manufactured within the same licensed premises or on contiguous premises of such agent licensed as a distillery; (ii) no single sample shall exceed one-half ounce of spirits, unless, unless served as a mixed beverage, in which case a single sample may contain up to one and one-half ounces of spirits; and (iii) no more than three ounces of spirits shall be given or sold to any person per day; and (iv) in the case of spirits samples, a method is used to track the consumption of each consumer.
