SUMMARY AS PASSED:
Cigarettes; possession with intent to distribute contraband; fraudulent purchase; penalties. Lowers the felony threshold for possession with intent to distribute tax-paid cigarettes from 500 cartons to 200 cartons and creates a criminal offense and civil penalties for purchasing cigarettes using a forged business license, a forged or invalid Virginia sales and use tax exemption certificate, or a business license or sales and use tax exemption certificate obtained under false pretenses. This bill is a recommendation of the Virginia State Crime Commission and is identical to HB 1807.

Lowers the felony threshold for possession with intent to distribute tax-paid cigarettes from 500 cartons to 200 cartons and creates a criminal offense and civil penalties for purchasing cigarettes using a forged business license or a forged or invalid Virginia sales and use tax exemption certificate or a business license or a sales and use tax exemption certificate obtained under false pretenses. As introduced, the bill is a recommendation of the Virginia State Crime Commission. The provisions of the bill are contingent on funding in a general appropriation act.
