SUMMARY AS PASSED SENATE: (all summaries)

Obtaining records concerning electronic communication service or remote computing service; authentication of contents of communications. Provides that, in obtaining contents of electronic communications, a provider of electronic communication service or remote computing service may verify the authenticity of those records by providing an affidavit from the custodian of those records, or from a person to whom such custodian reports, certifying in good faith that they are true and complete and prepared in the regular course of business. When so authenticated they are admissible in evidence as a business record exemption to the hearsay rule.  The good faith provision will also apply to the existing provision on verifying the authenticity of written reports or records obtained from a provider of electronic communication service or remote computing service.
