SUMMARY AS INTRODUCED:

Workers' compensation; presumption of compensability for certain diseases. Removes from the definition of toxic substance, for purposes of the Virginia Workers' Compensation Act, the requirement that the substance cause, or be suspected to cause, leukemia or other specific types of cancer. There currently exists a presumption that when certain employees have contact with a known or suspected carcinogen that causes, or is suspected to cause, leukemia or other specific types of cancer and then develop such a malady, the malady is an occupational disease covered by the Act. The measure also substitutes colorectal cancer for rectal cancer on the list of the types of cancer for which this presumption may exist.
