Be it enacted by the General Assembly of Virginia:

1. That §§ 3.1, as amended, and 3.7 of Chapter 646 of the Acts of Assembly of 1968 are amended and reenacted as follows:

§ 3.1. Election, qualification and term of office of council members and mayor.

(a) The Town of Herndon shall be governed by a town council composed of six council members and a mayor, all of whom shall be qualified voters of the town. Candidates for town offices shall not be identified on the ballot by political affiliation. In order to have their names placed on the ballot, all candidates shall be nominated only by petition as provided by general law pursuant to § 24.2-506 of the Code of Virginia.

(b) The mayor and council members shall be elected on the first Tuesday in May of each even-numbered year after the first Monday in November, beginning November 8, 2016, and in each subsequent even-numbered year. The mayor and council members elected under this section shall enter upon the duties of their offices on the first day of July January following the election. The mayor and council members shall continue to discharge the duties of their respective offices until their successors have qualified.

(c) The mayor and council members in office at the effective date of this charter amendment shall, by operation of § 24.2-222.1 of the Code of Virginia, continue in office for the terms of office for which they were elected through December 31 of the year in which each term was to expire.

§ 3.7. Vice mayor.

The At the first regular meeting in January after each municipal election, the town council shall elect from its members, by a majority of the members present, a vice mayor for a term extending through December 31 of the succeeding calendar year. During the absence or inability of the mayor to act, the vice mayor shall possess the powers and discharge the duties of the mayor. While serving in the place of the mayor, the vice mayor may vote as a member of the town council.
