15101234DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Article 3 of Chapter 12 of Title 18.2 a section numbered 18.2-511.2 as follows:
§ 18.2-511.2. Accepting compensation for removal of arrest photograph from Internet; penalty.
Any owner of a website who (i) is responsible for placing,
publishing, or otherwise disseminating on a website a photograph of an
individual taken by a law-enforcement agency pursuant to the arrest of the
photographed individual and (ii) [ solicits,
requests, or accepts extorts
] money or other thing of value for removing such photograph from the
website is guilty of a Class 1 misdemeanor.
Venue for a prosecution under this section may lie in the jurisdiction where the unlawful act occurred or where any photograph associated with a violation of this section is produced, reproduced, found, stored, or possessed.
