Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Chapter 1 of Title 22.1 a section numbered 22.1-7.2 as follows:

§ 22.1-7.2. Withholding a child from custodial parent by certain school board employees.

Any principal, assistant principal, or supervisor employed by a local school board who fails to or refuses to release a child into the custody of the child's custodial parent or other legal custodian is guilty of a Class 3 misdemeanor unless such failure or refusal is necessitated by a critical event or emergency governed by the school crisis, emergency management, and medical emergency response plan as defined in § 22.1-279.8.
