15103826DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 37.2-308.2 as follows:
§ 37.2-308.2. Routine review of emergency services; report.
The Department shall establish benchmarks and standards for emergency medical services provided by community services boards and behavioral health authorities and shall conduct annual reviews of emergency services provided by community services boards and behavioral health authorities to determine the extent to which community services boards and behavioral health authorities meet such benchmarks and standards. In conducting reviews of emergency services pursuant to this section, the Department shall review clinical documentation of services provided, including, for each case evaluated, documentation of all crisis intervention approaches attempted, collateral contact efforts undertaken and the results of such efforts, plans developed for family outreach during and after a crisis, and rationale for all actions taken by employees or designees of the community services board or behavioral health authority conducting an evaluation for emergency custody or temporary detention or providing emergency services.
The Department shall report the results of the review required by this section to the General Assembly no later than December 1 of each year.
