15101770DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 55-50.4 as follows:
§ 55-50.4. Private roads; covenants; maintenance and improvements.
No provision of a recorded deed or plat shall be enforceable if the provision prohibits the owner of the fee interest in a private road serving a subdivision of 50 or fewer lots from (i) dedicating the road for public use or (ii) reaching an agreement with the locality or the Department of Transportation for the improvement or maintenance of the road. The road owner shall obtain the consent of every lot owner to make such dedication or agreement.
