2015 SESSION
15102615DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Article 4.1 of Chapter 12 of Title 63.2 a section numbered 63.2-1242.4 as follows:
§ 63.2-1242.4. Child in custody of prospective adoptive parent(s) for five years or more.
When the child has been in the continuous legal and physical custody of the prospective adoptive parent(s) for five or more years, the adoption proceeding shall commence in the juvenile and domestic relations district court pursuant to the parental placement adoption provisions of this chapter; however, the juvenile and domestic relations district court may, in its discretion, waive the following requirements:
1. The home study provisions specified in subsection A of § 63.2-1231 and subdivision A 6 of § 63.2-1232; and
2. The meeting and counseling provisions, as they relate to the prospective adoptive parent(s), specified in subsection A of § 63.2-1231 and subdivision A 2 of § 63.2-1232.
