15100954DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 62.1-44.15:28.1 as follows:
§ 62.1-44.15:28.1. Dredging by municipal separate storm sewer system permittee.
Upon approval by the Chesapeake Bay Program as a creditable practice for pollutant removal under the Chesapeake Bay Watershed Model, the Board shall establish a procedure for the approval of dredging operations in the Chesapeake Bay Watershed by a locality that is a municipal separate storm sewer system (MS4) permittee as a method of meeting the pollutant reduction and loading requirements of its state permit. The specified portion of the bottom of the navigable waterway from which sediment deposits are to be removed shall be located within the jurisdictional boundaries of the MS4 permittee. The dredging operation and disposal of dredged material shall be conducted in compliance with all applicable local, state, and federal laws and regulations.
