Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 15.2-2241.2 as follows:

§ 15.2-2241.2. Land subdivision and development; approval not to be conditioned on consent of easement holder.

Notwithstanding any other provision of law, general or special, no locality shall condition approval of a subdivision plan, site plan, plat, or construction plan required pursuant to the provisions of this article, or issuance of any required occupancy permit for occupancy of such property or the structures thereon, upon the consent or permission of any person or entity holding an easement over, under, or through the property that is the subject of such plan or plat.
