Be it enacted by the General Assembly of Virginia:

1. § 1. That the Virginia Racing Commission may permit pari-mutuel wagering on simulcast horse racing from outside the Commonwealth in the absence of a contract between the holder of a license under the provisions of Chapter 29 (§ 59.1-364 et seq.) of Title 59.1 of the Code of Virginia and the recognized majority horseman's group as required under subdivision 14 of § 59.1-369 of the Code of Virginia, provided the licensee deposits an amount equal to the minimum percentage of the total pari-mutuel handle as required in clauses (i), (ii), and (iii) of subdivision 14 of § 59.1-369 of the Code of Virginia or such lesser amount as the Virginia Racing Commission may approve into the State Racing Operations Fund established pursuant to § 59.1-370.1 of the Code of Virginia. Such deposits shall be made within five days from the date on which the licensee receives wagers. Once a contract between the licensee and the recognized horseman's group is executed and approved by the Virginia Racing Commission, the Virginia Racing Commission is authorized to transfer such funds from the State Racing Operations Fund to the horsemen's purse accounts.

2. That an emergency exists and this act is in force from its passage.
