AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding in Chapter 9.1 of Title 19.2 a section numbered 19.2-152.12, relating to protective orders; compensation for required representation of respondents.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Chapter 9.1 of Title 19.2 a section numbered 19.2-152.12 as follows:

§ 19.2-152.12. Compensation for required representation of respondents.

Notwithstanding any other provision of law, when representation of a respondent by counsel or a guardian ad litem in a proceeding pursuant to this chapter is required by law and there is no other provision for the compensation of counsel or a guardian ad litem, the court may order such counsel or guardian ad litem to be compensated for services pursuant to § 19.2-163.

2. That the provisions of this act shall not become effective unless an appropriation effectuating the purposes of this act is included in a general appropriation act passed in 2015 by the General Assembly that becomes law.
