15103499DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 32.1-127.1:06 as follows:
§ 32.1-127.1:06. Limitations on disclosure and use of health information.
A. As used in this section, "health record" shall have the meaning set forth in § 32.1-127.1:03.
B. No agency of the Commonwealth or political subdivision of the Commonwealth shall disclose to any other state agency or any federal agency information contained in the health record of any individual, except as required by federal law or allowed pursuant to § 32.1-127.1:03, without written consent to such disclosure or use by the individual who is the subject of the health record or, if the individual is a minor, the consent of his parent or legal guardian.
C. Every agency of the Commonwealth or political subdivision of the Commonwealth that creates or maintains health records shall provide to the individual who is the subject of the record, upon request by the individual or, if the individual is a minor, the request of his parent or guardian, and without charge, an accounting of disclosures of such information made by the agency.
