Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding sections numbered 32.1-164.10 and 32.1-164.11 as follows:

§ 32.1-164.10. Community Wastewater Treatment Grant Fund.

There is hereby created in the state treasury a special nonreverting fund to be known as the Community Wastewater Treatment Grant Fund, referred to in this section as "the Fund." The Fund shall be established on the books of the Comptroller. All funds as may be appropriated by the General Assembly and any gifts, grants, or donations from public or private sources shall be paid into the state treasury and credited to the Fund. Interest earned on moneys in the Fund shall remain in the Fund and be credited to it. Any moneys remaining in the Fund, including interest thereon, at the end of each fiscal year shall not revert to the general fund but shall remain in the Fund. Moneys in the Fund shall be used solely for the purposes of providing grants in response to applications to the Community Wastewater Treatment Grant Program pursuant to § 32.1-164.11. Expenditures and disbursements from the Fund, which shall be in the form of grants, shall be made by the State Treasurer on warrants issued by the Comptroller upon written request signed by the Commissioner.

§ 32.1-164.11. Community Wastewater Treatment Grant Program.

A. As used in this section, unless the context requires a different meaning:

"Fund" means the Community Wastewater Treatment Grant Fund established pursuant to § 32.1-164.10.

"Grant" means a grant issued pursuant to this section.

B. Beginning January 1, 2016, any locality may apply for a grant from the Fund. Eligible localities shall provide matching funds, as provided in the appropriation act.

C. An applicant shall apply to the Board for a grant for the construction of community wastewater treatment systems in response to widespread onsite sewage system failure or potential failure. The Board shall issue grants in accordance with guidelines established by the Board. The guidelines shall include (i) criteria for grant eligibility, (ii) conditions to be included in the grants, (iii) grant distribution priorities, and (iv) general requirements for applying and qualifying for a grant. In the event that the amount of eligible grants requested in a fiscal year exceeds the funds available in the Fund, such grants shall be paid in the next fiscal year in which funds are available.
