Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 63.2-1809.2 as follows:

§ 63.2-1809.2. Child day programs; notice to parents of emergency situations.

A. As used in this section, "emergency situation" means (i) any case in which a child who is in the care of the child day program is lost or missing from the child day program, (ii) any emergency evacuation of the child day program or need for children enrolled in the child day program to shelter in place, or (iii) any serious injury to a child in the care of the child day program involving a wound or other specific injury to the body such as loss of consciousness, broken bones, dislocation, a laceration requiring stitches, a concussion, a foreign object lodged in the eye, nose, ear, or other bodily orifice, or any other injury requiring emergency medical care.

B. Every child day program licensed or registered by the Department shall notify the parent of every child enrolled in the child day program, in writing, of any emergency situation that occurs while the child is receiving care from the child day program, within 48 hours of the occurrence of such emergency situation. Such notice shall not include individually identifiable information about the child or children involved in the emergency situation, but shall provide information about the type of emergency situation that occurred, the outcome of the situation, and steps that the child day program has taken to prevent such emergency situation from occurring in the future.
