15101632DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Chapter 12 of Title 19.2 a section numbered 19.2-190.1 as follows:
§ 19.2-190.1. Certification of ancillary misdemeanor offenses.
Upon certification of any felony offense pursuant to this
chapter, the court shall also certify any ancillary misdemeanor offense to the
clerk of the circuit court provided that the attorney for the Commonwealth and
the accused consent to such certification. Any misdemeanor offense certified
pursuant to this section shall proceed in the same manner as a [ felony
offense certified pursuant to § 19.2-190 misdemeanor
appealed to circuit court pursuant to § 16.1-136 ] .
