15102536DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 46.2-2011.13:1 as follows:
§ 46.2-2011.13:1. Use of customers' personal information.
Except as required in this chapter, no motor carrier shall use personal information, as defined in § 2.2-3801, or any information that relates to a customer's trip data, including route and pickup and drop-off locations, for any purpose other than to provide the service requested and process payments, unless the disclosure is necessary to comply with a requirement imposed on the motor carrier by state or federal law. This limitation does not apply to aggregated data that cannot be linked to personal information within the meaning assigned to it in § 2.2-3801.
This section shall not prohibit a motor carrier from disclosing information required to protect or defend the terms and conditions for use of the service or investigate violations of the terms and conditions.
