15104216DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 29.1-318.1 as follows:
§ 29.1-318.1. Special permit to sell fish.
The Department shall establish a special permit to sell fish not regulated under § 29.1-417 that are stocked or propagated in waters wholly located within the boundaries of a person's land. The special permit shall include conditions prescribed by the Board and shall be issued upon application by the landowner to the Department. The fee for the special permit shall be based on the costs to the Department of developing and administering the special permit. The special permit shall be valid for two years and may be renewed by application to the Department. No fish stocked in such private waters shall be taken from state waters. No special permit shall be issued for invasive or predatory and undesirable species, threatened and endangered species, or species that are not included on the list of native and naturalized fauna maintained by the Department.
