15100653DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 23-9.2:13.1 as follows:
§ 23-9.2:13.1. Students; alleged violations of institution's policies for the conduct of students; right to representation at proceedings.
A. Except in the case of students enrolled at Virginia Military Institute, any student enrolled at a public institution of higher education who is alleged to have committed an offense that is punishable by a suspension of more than 10 days or by expulsion pursuant to the institution's policies for the conduct of students has the right to be represented, in his discretion and at his expense, by a licensed attorney or a nonattorney advocate for the duration of any disciplinary proceeding or other institutional proceeding regarding the alleged offense.
B. Nothing in this section shall be construed to create a right for students to be represented at public expense at a disciplinary proceeding or other institutional proceeding regarding the alleged offense.
