Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 19.2-303.6 as follows:

§ 19.2-303.6. Felony conviction may be reduced to misdemeanor under certain conditions.

Notwithstanding any other provision of law, subsequent to a conviction of a felony, whether with or without a jury, the court may reduce a felony, other than an act of violence as defined in § 19.2-297.1, to a misdemeanor pursuant to a plea agreement if the terms of the plea agreement are merged into a sentencing order in which the court retains jurisdiction and the court determines that all terms and conditions of the plea agreement are satisfied.
