Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 55-70.1:1 as follows:

§ 55-70.1:1. Additional implied warranty under certain circumstances.

In addition to the implied warranties provided by § 55-70.1, if the vendor (i) is in the business of building or selling new dwellings and (ii) selected and installed the materials and fixtures used in the construction of the dwelling, he shall be held to warrant to the vendee that if a defect occurs in the materials or fixtures that were selected and installed in the event that the manufacturer does not fulfill the warranty, then the vendor will fulfill the warranty.
