Be it enacted by the General Assembly of Virginia:

1. § 1. That if the Commonwealth's program of medical assistance established pursuant to Title XIX of the Social Security Act (42 U.S.C. §1396 et seq.) (Medicaid) and Title XXI of the Social Security Act (CHIP) is amended to implement the requirements of the federal Patient Protection and Affordable Care Act (PPACA) as it pertains to expansion of Medicaid eligibility up to 133 percent of federal poverty guidelines, the Department of Medical Assistance Services shall prepare, submit, and seek approval of an application for a waiver, pursuant to Section 1115 of the Social Security Act (42 U.S.C. § 1315), of certain requirements related to the state plan for medical assistance, to establish work search requirements for all working-age unemployed or underemployed enrollees, which shall include requirements for participation in education, job training, and employment search activities for all working-age, unemployed or underemployed enrollees and penalties for failure to comply with such work search requirements.

§ 2. That the Department shall report to the Governor and the General Assembly on its progress in preparing, submitting, and seeking approval of the waiver required pursuant to § 1 of this act, the status of the application, and the elements of the proposed program, no later than December 1, 2014.
