14100586DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Article 3 of Chapter 12 of Title 18.2 a section numbered 18.2-511.2 as follows:
§ 18.2-511.2. Accepting compensation for removal of arrest photos from Internet; penalty.
Any owner of a website who (i) is responsible for placing, publishing, or otherwise disseminating on a website a photograph of an individual taken by a law-enforcement agency pursuant to the arrest of the photographed individual and (ii) solicits, requests, or accepts money or other thing of value for removing such photograph from the website is guilty of a Class 1 misdemeanor.
Venue for a prosecution under this section may lie in the jurisdiction where the unlawful act occurred or where any photograph associated with a violation of this section is produced, reproduced, found, stored, or possessed.
