Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 32.1-325.04 as follows:

§ 32.1-325.04. Individuals confined in Department of Juvenile Justice; eligibility for medical assistance.

A person who is in the custody of the Department of Juvenile Justice shall be eligible for and enrolled in the state program for medical assistance if (i) he was in foster care at the time he was committed to the Department of Juvenile Justice and (ii) he meets the eligibility criteria for medical assistance; however, no services under the state program for medical assistance shall be furnished to the person while he is confined in a Department of Juvenile Justice facility unless federal financial participation is available to pay for the cost of the services provided. Upon release from a Department of Juvenile Justice facility, such individual shall continue to be eligible for services under the state program for medical assistance until such time as the person is determined to no longer be eligible for medical assistance. To the extent permitted by federal law, the time during which a person is confined in a Department of Juvenile Justice facility shall not be included in any calculation of when the person must recertify his eligibility for medical assistance.
