Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 1 of Chapter 3 of Title 33.1 a section numbered 33.1-252.3 as follows:

§ 33.1-252.3. Electronic tolling facilities; maintenance fees.

For all-electronic toll facilities, the Department of Transportation or the operator of the toll facility shall either (i) pay the maintenance fees associated with the transponders held by drivers living within a 50-mile radius of the toll facility or (ii) require that drivers not using electronic transponders and paying by plate pay the same fees as those paid by drivers using electronic transponders.
