SENATE BILL NO. 123 AMENDMENT IN THE NATURE OF A SUBSTITUTE (Proposed by the Senate Committee on Agriculture, Conservation and Natural Resources on January 16, 2014) (Patron Prior to Substitute--Senator Garrett) A BILL to amend the Code of Virginia by adding a section numbered 29.1-556.2, relating to wind turbines; striking of wild birds and animals.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 29.1-556.2 as follows:

§ 29.1-556.2. Protection of wildlife from wind turbine blades.

Notwithstanding any other provision of law, the Board shall consult with the Department of Environmental Quality on the development and revision of permit by rule regulations for the construction and operation of wind and other renewable energy projects pursuant to Article 5 (§ 10.1-1197.5 et seq.) of Chapter 11.1 of Title 10.1 and in the Department of Environmental Quality's determination of permit by rule coverage for wind and other renewable energy projects. The Board shall advise the Department of Environmental Quality concerning measures to avoid, minimize, or otherwise mitigate significant adverse impacts of such projects on wildlife.
