Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 29.1-556.2 as follows:

§ 29.1-556.2. Protection of wild birds and animals from wind turbine blades.

The Board shall adopt regulations that establish mitigation measures to minimize the adverse effects of wind energy projects upon the environment, specifically upon wild birds and animals including bats. Measures may include the use of stripes or other visual markers on turbine blades or the incorporation of sonic devices into a turbine structure to repel birds and bats flying at night.
