Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 5 of Chapter 14 of Title 22.1 a section numbered 22.1-287.01 as follows:

§ 22.1-287.01. Student information; release to federal government agencies and commerical educational entities.

No member or employee of a local school board or the Department of Education shall transmit personally identifiable information, as that term is defined in the Family Educational Rights and Privacy Act (20 U.S.C. § 1232g) and related regulations, from a student's record to a federal government agency or any commercial educational entity or an authorized representative of such agency or entity for purposes permitted by local, state, or federal law unless the member or employee first notifies the student's parent or the student, in the case of a student who is eighteen years of age or older, and provides the parent or student with the opportunity to opt out of the transmission.
