Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding sections numbered 8.01-390.3 and 19.2-188.4 as follows:

§ 8.01-390.3. Recordings and records of 911 emergency service calls; admissibility in civil proceedings.

Recordings and records of 911 emergency service calls shall be admissible in evidence provided such recordings and records, or copies of such recordings and records, are authenticated to be true and accurate by the custodian thereof or by the person to whom the custodian reports. A certificate signed by the custodian of such recordings and records, or by the person to whom the custodian reports, stating that such recordings and records are true and accurate copies thereof, the date and time of the incoming call, and the incoming phone number associated with the call shall be valid authentication for the purposes of this section.

§ 19.2-188.4. Recordings and records of 911 emergency service calls; admissibility in criminal proceedings.

In any criminal proceeding, recordings and records of 911 emergency service calls shall be admissible in evidence provided such recordings and records, or copies of such recordings and records, are authenticated to be true and accurate by the custodian thereof or by the person to whom the custodian reports. A certificate signed by the custodian of such recordings and records, or by the person to whom the custodian reports, stating that such recordings and records are true and accurate copies thereof, the date and time of the incoming call, and the incoming phone number associated with the call shall be valid authentication for the purposes of this section.
