SUMMARY AS INTRODUCED:
Death of joint petitioner prior to entry of final order of adoption. Provides that in cases in which married persons, or persons who were previously married who are permitted to adopt a child, have jointly petitioned to adopt a child and one of the petitioners dies before entry of a final order of adoption, the adoption may proceed in the name of both petitioners and, upon entry of a final order, the child shall be, to all intents and purposes, the child of both petitioners. The bill also provides that in cases in which a child is placed with prospective adoptive parents who are married persons and one spouse dies prior to filing of a petition for adoption of the child, the surviving spouse may file a petition to adopt the child and have the deceased spouse named as the parent of the child and the court may grant such petition upon submission of evidence that the deceased prospective adoptive parent intended to adopt the child.
