13103147DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 46.2-1078.2 as follows:
§ 46.2-1078.2. Use of handheld personal communications devices in specified school zones prohibited; penalty.
A. Any person who operates a moving motor vehicle within a school zone or school crossing zone as defined in § 46.2-873 while using any handheld personal communications device in any manner for any purpose is guilty of a traffic infraction punishable by a fine of no more than $250. Any signs that are erected or have been erected pursuant to § 46.2-873 shall contain a notice indicating that the use of handheld personal communications devices is prohibited within the zone.
B. The provisions of this section shall not apply to any law-enforcement officer while engaged in the performance of his official duties or any school personnel while engaged in the performance of their official duties.
