A BILL to require the Department of Medical Assistance Services to designate certain waiver slots for dependents of active duty military personnel stationed in the Commonwealth.

Be it enacted by the General Assembly of Virginia:

1.  § 1. That the Department of Medical Assistance Services shall designate 10 Mental Retardation/Intellectual Disabilities Medicaid Waiver slots, 10 Individual and Family Developmental Disability and Support Medicaid Waiver slots, and 10 Day Support Medicaid Waiver slots for dependents of active duty military personnel stationed in the Commonwealth. Dependents of active duty military personnel stationed in the Commonwealth who meet the criteria for eligibility for the Mental Retardation/Intellectual Disabilities Medicaid Waiver, Individual and Family Developmental Disability and Support Medicaid Waiver, or Day Support Medicaid Waiver shall not be added to any existing waiting list for such waiver services but shall be eligible for one of the 10 slots designated for such individuals. The Department shall maintain a separate waiting list for such waiver slots. In any case when an active duty military personnel member whose dependent is receiving services through a specially designated Mental Retardation/Intellectual Disabilities Medicaid Waiver, Individual and Family Developmental Disability and Support Medicaid Waiver, or Day Support Waiver slot is transferred to a station outside of the Commonwealth, such personnel's dependent shall no longer be eligible for such specially designated waiver slot.
