Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 38.2-3442.1 as follows:
§ 38.2-3442.1. Diagnostic services, tests, and related procedures resulting from preventive care or screening.
If, during the course of administering or conducting preventive care or screening, a provider performs diagnostic services, tests, or related procedures, then (i) the diagnostic services, tests, or related procedures shall be billed separately from the preventive care or screening and (ii) if the health carrier is prohibited pursuant to subdivision A 1, A 3, or A 4 of § 38.2-3442 from imposing any cost-sharing requirements with respect to the preventive care or screening, the health carrier shall not impose any cost-sharing requirements with respect to the diagnostic services, tests, and related procedures that are administered or conducted in conjunction with the preventive care or screening. In such an event, the health carrier shall not require the payment of a copayment, coinsurance, or deductible for the diagnostic services, tests, or related procedures performed during the course of administering or conducting the preventive care or screening. An example of a diagnostic service, test, or related procedure performed during the course of administering or conducting preventive care or screening is the removal or collection of cells, tissue, or polyps for diagnostic or curative purposes performed in conjunction with and at the time of a colorectal cancer screening.
