Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding a section numbered 33.1-23.03:11 as follows:

§ 33.1-23.03:11. Use of certain toll revenues.

Except as provided in 33.1-23.03:4 and subsection D of § 33.1-23.03:10, no toll revenues nor any portion of any such revenues shall be used or allocated by the Commonwealth, any locality, or any other entity through agreement with the Commonwealth or any locality, for any purpose other than the construction, reconstruction, replacement, maintenance replacement, improvement, or maintenance of a highway, bridge, or tunnel facility, or financing of the foregoing, for the use of which the tolls were imposed and collected.

The provisions of this section shall not apply to any toll imposed and collected for the use of any public highway, bridge, or tunnel on January 1, 2013.
