Be it enacted by the General Assembly of Virginia:

1.  § 1. Notwithstanding any contrary provision of law, no revenues of the Commonwealth, from whatsoever source, shall be allocated, paid, or expended in connection with Phase II of the Dulles Corridor Metrorail Project beyond Wiehle Avenue in Fairfax County to Washington Dulles International Airport and on to Virginia Route 772 in Loudoun County unless:

1. The Inspector General of the U.S. Department of Transportation has determined in writing that all of the deficiencies noted in his November 2012 report on the Metropolitan Washington Airports Authority (MWAA) have been corrected;

2. The MWAA has certified in writing to the Commonwealth Transportation Board that the MWAA is no longer under review by the Federal Bureau of Investigation for possible violations of law;

3. The Governor has determined, in consultation with the Virginia Freedom of Information Advisory Council, that the freedom of information policies of the MWAA are substantially the same in all material respects in scope and process to the provisions of the Virginia Freedom of Information Act (§ 2.2-3700 et. seq. of the Code of Virginia) that are relevant to the operations of the MWAA; and

4. The MWAA has submitted to the Commonwealth Transportation Board a financing plan for Phase II of the Dulles Corridor Metrorail Project that, as determined by the Commonwealth Transportation Board, does not rely on additional toll increases on the Dulles Toll Road specifically dedicated to financing Phase II of the Dulles Corridor Metrorail Project.
