Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding a section numbered 33.1-223.2:29 as follows:

§ 33.1-223.2:29. Tolling fees.

The Department shall not charge motorists monthly fees for the maintenance or expansion of the automated electronic tolling payment program and its transponders. Wherever a toll is imposed and collected by the Department or such other entity as may be responsible for imposing or collecting such toll, the amount of the toll shall be as fixed and revised by the Commonwealth Transportation Board or such other entity as may be responsible for fixing or revising the amount of such toll. Such toll may include costs for the maintenance and operation of the automated electronic tolling payment program.
