S.B. 698 Peanuts; extends excise tax on those grown in and sold in Virginia.

Patron: Lucas

Excise tax on peanuts. Extends the $0.30 per 100 pounds excise tax on all peanuts grown in and sold in Virginia until July 1, 2016. The proceeds from the tax will be used for promoting the sales and use of Virginia peanuts.

S.B. 768 Chesapeake Bay Watershed Implementation Plan; directs state agencies to remove Lynnhaven River.

Chesapeake Bay Watershed Implementation Plan. Directs state agencies to remove the Lynnhaven River watershed from inclusion in the James River Basin for purposes of the Chesapeake Bay Watershed Implementation Plan.

S.B. 828 Dangerous and vicious dogs; authorizes animal control officer to apply to magistrate for summons.

Control of dangerous and vicious dogs; penalties. Authorizes an animal control officer or law-enforcement officer to apply to a magistrate for a summons where the officer believes that the owner of a dangerous or vicious dog has willfully failed to comply with the law. The bill clarifies the distinctions between dangerous dogs and vicious dogs, requires the owner of either type of dog to provide basic care while confining the animal, and authorizes a court to order the owner to pay for the care of a dangerous or vicious dog while it is in state custody.

S.B. 880 Nontidal waters; DGIF, et al., to inventory those in State for recreational use.

Inventory of nontidal waters that are available for public recreation. Directs the Department of Game and Inland Fisheries and the Virginia Marine Resources Commission to cooperatively inventory nontidal waters that flow above state-owned bottomlands and that may be used by the public for recreation. The bill prohibits an agency decision regarding the listing of particular waters from constituting a legal determination or affecting land ownership.

S.B. 946 Public beaches; authorizes MRC and DEQ to establish procedure for sand replenishment.

Sand replenishment for public beaches. Authorizes the Marine Resources Commission and the Department of Environmental Quality to establish an expedited procedure for sand mining and beach replenishment on the public beaches abutting the waters of the Chesapeake Bay. The bill requires the agencies to establish a working group, consisting of representatives from affected localities, to assist in the development of the expedited procedure. The working group is to consider a requirement that the application for the sand replenishment project permit include the submission of a mining plan by the locality for areas within the Chesapeake Bay from which the dredged material will be taken and the location of the beach replenishment project. The bill provides several types of information that such a plan would include, such as the analysis of benthic, marine, and fishery resources; impact on any historical artifacts; and impact on other uses of the state waters and bottomlands at the dredge site.

S.B. 954 Drone; willfully impeding hunting, Class 3 misdemeanor.

Impeding hunting; drones; penalty. Provides that the use of a drone by a private person to monitor and photograph persons lawfully hunting on private property, when the drone is used by a private person without the permission of the landowner, constitutes impeding hunting, a Class 3 misdemeanor.
