SUMMARY AS ENACTED WITH GOVERNOR'S RECOMMENDATION:

Manner of enforcement of state criminal offenses.  Provides that when a law-enforcement officer of the Department of State Police or any other division of the state government makes an arrest or issues a summons for a violation of a provision of the Code of Virginia, the person arrested or summoned must be charged with a violation of that Code provision and not with a substantially similar local ordinance. All fines collected upon conviction are to be credited to the Literary Fund.

SUMMARY AS PASSED:

Manner of enforcement of state criminal offenses.  Provides that when a law-enforcement officer of the Department of State Police or any other division of the state government makes an arrest or issues a summons for a violation of a provision of the Code of Virginia, the person arrested or summoned must be charged with a violation of that Code provision and not with a substantially similar local ordinance. All fines and forfeitures collected upon conviction are to be credited to the Literary Fund.

SUMMARY AS PASSED HOUSE:

Manner of enforcement of state criminal offenses and local criminal ordinances.  Provides that all fines and forfeitures collected upon conviction or upon forfeiture of bail for a violation of a local ordinance are to be paid into the locality's treasury and that when a law-enforcement officer of (i) the Department of State Police or (ii) any other division of the state government makes an arrest or issues a summons for a violation of a provision of the Code of Virginia, the person arrested or summoned shall be charged with and tried for a violation of that Code provision and shall not be charged with and tried for a substantially similar local ordinance. All fines and forfeitures collected upon conviction or upon forfeiture of bail of any person so arrested or summoned shall be credited to the Literary Fund.

SUMMARY AS INTRODUCED:

Manner of enforcement of state criminal offenses and local criminal ordinances.  Provides that when a person is summoned or arrested for a misdemeanor offense under the Code of Virginia he shall be charged and tried for that offense and shall not be charged and tried for a violation of a local ordinance representing a like offense.
