WHEREAS, Virginia law requires judges to retire at age 70; and

WHEREAS, a number of states are presently considering changes in judicial retirement, including raising the mandatory retirement age for judges; and

WHEREAS, increasing the mandatory retirement age may save money in the retirement trust fund and may also enable the state to take advantage of the service of experienced workers; and

WHEREAS, although the General Assembly has considered several measures increasing judicial retirement age, no consensus has been reached on an age or on the practicalities of doing so; now, therefore, be it

RESOLVED by the Senate, the House of Delegates concurring, That the State Crime Commission be directed to study mandatory retirement of judges. In conducting its study, the Commission shall determine the financial impact of increasing the mandatory age of retirement for judges and the effect such an increase will have on the service provided by such judges.

Technical assistance shall be provided to the State Crime Commission by the Virginia Retirement System. All agencies of the Commonwealth shall provide assistance to the Commission for this study, upon request.

The State Crime Commission shall complete its meetings by November 30, 2012, and the Chairman shall submit to the Division of Legislative Automated Systems an executive summary of its findings and recommendations no later than the first day of the 2013 Regular Session of the General Assembly. The executive summary shall state whether the Commission intends to submit to the General Assembly and the Governor a report of its findings and recommendations for publication as a House or Senate document. The executive summary and report shall be submitted as provided in the procedures of the Division of Legislative Automated Systems for the processing of legislative documents and reports and shall be posted on the General Assembly's website.
