AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding a section numbered 22.1-212.25:1, relating to public schools; virtual education.

Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding a section numbered 22.1-212.25:1 as follows:

§ 22.1-212.25:1. Enrollment in virtual school programs.

A. Effective July 1, 2013, any local school division that offers, either directly, through a contract with another school division, or through a multidivision online provider a full-time virtual school program may require that students within its school division who choose to enroll in a virtual school program enroll in such program offered by the school division. 

B. Effective July 1, 2013, any student who resides in a local school division that does not offer a full-time virtual school program, either directly, through a contract with another school division, or through a multidivision online provider may seek to enroll on a full-time basis in any virtual school program in the Commonwealth.  If such student is accepted for enrollment in the other school division, the state and local funding for any such student shall be as provided in the current general appropriations act.
