Be it enacted by the General Assembly of Virginia:

1. § 1. Notwithstanding the provisions of §§ 32.1-102.3 and 32.1-102.3:2 of the Code of Virginia, any regulations of the Board of Health, or provisions of any current Request for Applications issued pursuant to § 32.1-102.3:2 of the Code of Virginia, the Commissioner of Health shall accept applications, shall review such applications in any certificate of public need Batch Group C review cycle, and may issue a certificate of public need for the establishment of a psychiatric service and the addition of up to 30 psychiatric inpatient beds, provided that: (i) the psychiatric service to be established shall be located in a general acute care hospital, licensed as of December 31, 2011, and located in Virginia Beach, in Planning District 20, and; (ii) the psychiatric beds to be approved shall result entirely from the conversion of acute care beds licensed as of December 31, 2011, and located at the general acute care hospital where the psychiatric service and beds are to be located or at another acute care hospital in PD 20 that is part of the same system as is the hospital where the psychiatric service and psychiatric beds are to be located.
