AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to prohibit use of revenues of the Commonwealth in connection with construction of Phase II of the Dulles Corridor Metrorail Project.

Be it enacted by the General Assembly of Virginia:

1.  § 1. Notwithstanding any contrary provision of law, no revenues of the Commonwealth, from whatsoever source, shall be allocated, paid, or expended in connection with Phase II of the Dulles Corridor Metrorail Project beyond Wiehle Avenue in Fairfax County to Washington Dulles International Airport and on to Virginia Route 772 in Loudoun County if the project or phase of the project in its bid specifications, project agreement, or other controlling documents:

A. Requires or prohibits bidders, offerors, contractors, or subcontractors to enter into or adhere to agreements with one or more labor organizations, on the same or related public works projects; or

B. Otherwise discriminates against bidders, offerors, contractors, subcontractors, or operators for becoming or refusing to become or remain signatories or otherwise to adhere to agreements with one or more labor organizations, on the same or other related public works projects.

Nothing in this section shall prohibit contractors or subcontractors from voluntarily entering into agreements described in subsection A.
