Be it enacted by the General Assembly of Virginia:

1.  § 1. That the City of Fairfax shall conduct a study to identify which residential housing units within the City meet the requirements of subdivision B 2 of § 36-105.1:1 of the Code of Virginia for the purpose of establishing proper rental inspection districts within the City. The study shall (i) identify by individual property addresses specific residential dwelling units proposed to be included in the proposed rental inspection districts and (ii) clearly state the statutory basis for inclusion of each such residential housing unit in the proposed rental inspection district. The statutory criteria under this section for inclusion of residential housing units in a rental inspection district require each such residential dwelling unit to be either (a) blighted or in the process of deteriorating or (b) in need of inspection by the building department to prevent deterioration, taking into account the number, age, and condition of residential rental dwelling units inside the proposed rental inspection district, and the inspection of residential rental dwelling units inside the proposed rental inspection district is necessary to maintain safe, decent, and sanitary living conditions for tenants and other residents living in the proposed rental inspection district. The City shall identify the applicable statutory criteria for each specific individual property proposed for inclusion in a rental inspection district.

§ 2. The City of Fairfax shall complete this study and present the findings to the Fairfax City Council. Upon receipt and consideration of the study, the Fairfax City Council shall repeal its existing rental inspection ordinance and adopt a new rental inspection ordinance that complies with the provisions of § 36-105.1:1 of the Code of Virginia and this act on or before October 31, 2012. On or before November 1, 2012, the City of Fairfax shall submit its new rental inspection ordinance to the Virginia Housing Commission.
