Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding in Chapter 12 of Title 2.2 a section numbered 2.2-1209 as follows:

§ 2.2-1209. State employees killed in line of duty; state flag to next of kin.

A. As used in this section, unless the context requires a different meaning:

"Next of kin" means the surviving spouse, child, sibling, or parent of a state employee.

"State agency" means any authority, board, department, instrumentality, institution, agency, or other unit of state government. The term shall not include any county, city, or town or any local or regional governmental authority.

"State employee" means any person who is regularly employed full time on a salaried basis, whose tenure is not restricted as to temporary or provisional appointment, who is in the service of, and whose compensation is payable, no more often than biweekly, in whole or in part, by the Commonwealth or any department, institution, or agency thereof.

B. Whenever a state employee is killed or dies from injuries sustained in connection with employment with a state agency as a result of a criminal act, an act of terrorism, a natural disaster, or other circumstance as determined by the Governor, the Director of the Department shall furnish a state flag to the employee's next of kin, upon request.

C. The Director may develop necessary guidelines to implement the provisions of this section. The Director shall provide appropriate notice to state agencies of the flag benefit provided for under this section.
