12103307DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 2.2-803.2 as follows:
§ 2.2-803.2. Payroll deductions for state employee associations prohibited.
A. As used in this section, "state employee association" means any nonprofit organization, membership in which is voluntary, that provides programs or services of general benefit to member state employees within the context of their employment. The term includes such associations that are sponsored or associated with a specific state agency and those statewide associations that are open to all employees who elect to participate without sponsorship or affiliation with a specific state agency.
B. Neither the Department of Accounts nor any other state agency, department, board, commission, or institution, including those operating their own payroll systems, shall establish, support, or administer payroll deductions regarding a state employee's membership fees, dues, or similar payments for or to any state employee association.
C. This section shall not prohibit the Department of Accounts or any state agency, department, board, commission, or institution from establishing, supporting, or administering payroll deductions for charitable organizations or foundations, including those affiliated with state agencies and institutions.
