2. That any child who is born with a gross and totally incapacitating physical deformity or mental deficiency to a woman who meets the financial eligibility criteria for services under the state plan for medical assistance at the time of the child’s birth and who meets non-financial eligibility criteria for services through the Mental Retardation Medicaid Waiver or the Individual and Families Developmental Disabilities and Support Medicaid Waiver shall be provided such services.
